Viral hepatitis epidemic broke up in Akhaltsikhe at the end of 2001. The Union of Democrat Meskhs led the law case for three years.  The injured citizens asked for compensation of property damage during epidemic because viral hepatitis needs to be on a diet and curing with medicine.  The Union of Democrat Meskhs led the process where about 500 citizens demanded compensation from the State, local governmental and self-governmental bodies. It is the only precedent in Georgia when mass trial is held and the citizens are demanding compensation of the damage from government. Hepatitis was caused for two reasons: drinking water pollution and poor sanitary conditions. Accordingly the Union of Democrat Meskhs involved town and district government as defendants. They are responsible to solve the problem. Lawyers of the Union met every aggrieved person and gathered a great number of documentation. Expertise was held as it was necessary that all the details be explained on the trial. The Union had problems with many governmental bodies. Office of Public Prosecutor decided to start investigation against the Union of Democrat Meskhs. They threatened and warned that if we did not stop the trial they would make decisions against the Union as it was hampering the investigation. However the Union managed not to stop the process. During 2002 the Union of Democrat Meskhs was preparing the case. Change of the judge became necessary as he slowed down the process.

The organization won the court of first instance on June 13, 2003 and the Court ordered the district and town Gamgeoba to pay 40,000 from asked 140,000 GEL for injured citizens. The Union of Democrat Meskhs got together injured citizens and asked district and town Gamgeoba to admit the damage and pay compensation. Town Gamgeoba declared that it would not appeal the decision and would pay.

District Gamgeoba appealed the District Court decision at the Tbilisi Regional Court and the Union of Democrat Meskhs brought the lawsuit.

    On 24 December 2003 appellants applied Tbilisi Regional Court and refused to appeal the District Court decision. Appellation Chamber considered the case and stoped the process according to the Administrative process Code of Georgia. Appellant can refuse to bring the suit.

    District Gamgeoba as well as Town Gamgeoba agreed to pay the compensation to the injured citizens. The amount is defined in 2004 budget and every aggrieved person will get money.
